Effective date: October 28, 2026
The short version, which is not part of the agreement: ConcertDome Inc. runs the venues, presents the shows and sells the tickets. The price you see is the ticket price, plus sales tax shown before you pay unless the show page says the price includes tax. Your ticket is a QR code that works like cash: whoever shows it first gets in. Change of mind is at our discretion: where a show allows it, you can refund to ConcertDome credit before the cutoff shown at checkout; otherwise all sales are final. If we cancel a show, we refund what you paid to your card (any part paid with credit goes back to your credit). Disputes go to individual arbitration rather than court, with coordinated claims handled in batches, and not to class actions. You agree to all of this when you select Place Order.
1. Who we are and what these Terms cover
1.1 These Terms of Service (the "Terms") are a binding agreement between you and ConcertDome Inc., a Texas corporation, 12420 Thompkins Dr, Austin, TX 78753 ("ConcertDome," "we," "us," "our"). We own and operate the ConcertDome venues, present the shows at them, sell the tickets, and run the website at www.concertdome.co, including its ticketing pages, checkout, accounts, tickets, dashboards and emails (together, the "Service"). "You" means the person who buys a ticket, holds a ticket, holds ConcertDome credit, or otherwise uses the Service.
1.2 These Terms cover your use of the Service and your purchase, holding, transfer and use of tickets. The Refund, Credit and Ticket Policy, which governs refunds, credit, cancellations, postponements and transfers, is part of these Terms and is incorporated by reference. If these Terms conflict with that policy, the policy governs on the point of conflict. If either conflicts with a help article, an FAQ or anything a member of our staff says, these Terms and that policy govern. Our Privacy Policy describes what personal information we collect and how we use it; it is a notice, not part of this agreement.
1.3 Show rules. We may publish rules for a particular venue, show or promotion, on the show page, at the venue or at checkout. Those rules apply in addition to these Terms.
1.4 Shows presented with others. Some shows we sell are produced with or for another company. You are still buying your ticket from us, and these Terms, including the refund, credit and entry rules, apply to that ticket in the same way unless explicitly stated on the event page.
2. Agreeing to these Terms
2.1 You agree to these Terms when you select Place Order (or any similarly labeled button) at checkout, when you sign in to your account, or when you accept a ticket transferred to you. Each of those screens tells you that the action means agreement.
2.2 If you do not agree, do not buy a ticket and do not use the Service.
2.3 Each version of these Terms has an effective date. The version in effect when you place an order governs that order. We keep prior versions available.
3. Who can buy and who can attend
3.1 Buying. You must be at least 18 years old and able to enter into a binding contract to buy a ticket or hold ConcertDome credit. If you buy for a family or a group, you are our customer and you are responsible for the order and for everyone attending on it.
3.2 Attending. Our shows are all ages unless the show page says otherwise. A child under 16 must be accompanied by an adult unless the show page says otherwise. Where a show, a seating area or alcohol service is age-restricted, you must show valid photo ID on request, and admission is refused without refund if you cannot.
3.3 The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. See the Privacy Policy.
4. Your account and how signing in works
4.1 You do not need an account to buy a ticket. When you buy, we create an account tied to the email address you used, so that your tickets and any credit have somewhere to live.
4.2 There are no passwords. To sign in, you enter your email address and we send you a sign-in link and a code. Your email inbox is therefore your account. Anyone who can read your email can sign in as you, see and transfer your tickets, and spend your credit. You are responsible for everything done through your account, and for keeping your email account secure. Tell us at once if you think someone else has access. If the email address on your account is changed, we tell the old address, and the change can be undone from there for 72 hours.
4.3 We will never ask you for a ConcertDome password, because there is not one.
4.4 One account per person. Do not share, sell or transfer your account, and do not create accounts to get around a restriction we have placed on you.
5. Electronic communications
5.1 The Service runs on email. You agree that we may give you notices, agreements, disclosures, receipts, tickets and other communications electronically, and that these satisfy any legal requirement that they be in writing. To receive them you need a device with internet access and an email account that can receive our messages.
5.2 Your order confirmation email is your receipt and your ticket delivery. It is your responsibility to give us a correct email address and to make sure our messages reach you, including by checking your spam folder.
5.3 While you hold a ticket or a credit balance, we will send you service emails about your orders, tickets and shows, including changes and cancellations. These are not marketing and cannot be turned off. Marketing email is separate, and you can unsubscribe from it at any time.
5.4 You may ask us for a paper copy of anything we sent electronically, and you may withdraw your consent to electronic communications, by contacting us. Because tickets are delivered by email, we cannot sell you a ticket if you withdraw that consent.
5.5 Text messages. If we offer text messaging and you opt in by giving us your mobile number and checking the box or replying to our invitation, you agree to receive recurring automated text messages from ConcertDome at that number, which may include marketing about our shows as well as ticket and show information. Consent to marketing texts is not a condition of buying anything. Message frequency varies, and message and data rates may apply. Reply STOP to any message to stop, or HELP for help. You confirm that you are the subscriber or customary user of the number you give us, and you agree to tell us if it changes. We are not responsible for delayed or undelivered messages caused by your carrier.
6. Prices, tax and payment
6.1 We do not add service, processing or delivery fees. The price shown is the ticket price. Sales tax is added and shown on its own line before you pay, unless the show page says the price includes tax.
6.2 Prices may change over time. You pay the price shown when you place your order.
6.3 Price errors. If a price was displayed in error, we may contact you before the show and give you the choice of confirming the order at the correct price or canceling it for a full refund to your original payment method. If we cannot reach you, we may cancel the order and refund you.
6.4 How you pay. We accept major credit and debit cards and digital wallets such as Apple Pay and Google Pay, through our payment processor, Stripe. We may add or remove payment methods or change payment processors. Our charge appears on your statement as CONCERTDOME.
6.5 ConcertDome credit. If you hold credit and are signed in, it is applied to your order before your card is charged, unless you choose otherwise at checkout. See the Refund, Credit and Ticket Policy.
7. Placing an order
7.1 When you select tickets we may hold them for you briefly while you check out. A hold is not a purchase. If it expires, the tickets go back on sale.
7.2 When you place your order, you make an offer to buy. Your order is accepted, and the contract for the tickets is formed, when your payment succeeds and we issue your tickets to your account. Your confirmation email follows. If we cannot issue the tickets, we refund the payment. We may decline an order for any lawful reason before issuing tickets, in which case you are not charged, or you are refunded in full.
7.3 Purchase limits. Unless the show page says otherwise, you may buy no more than 10 tickets per order and per show, counted per person, household, payment card and account. Limits exist to keep tickets available to fans. We may cancel orders that exceed a limit, or that we reasonably believe were placed using bots, multiple accounts, multiple cards or other means of getting around a limit; where we do, we refund the price you paid for the tickets, including sales tax, and we may close the accounts involved.
7.4 Suspected fraud. If we reasonably suspect that an order is fraudulent or was paid for with a stolen card, we may cancel the order and the tickets and refund the card that was charged, without notice and without explaining what we saw. If you think we have got it wrong, contact us.
8. Your tickets
8.1 A ticket is a revocable license to attend the show and session it names, once, subject to these Terms and the show rules. It is not property, a security or an investment. Where these Terms say a ticket may be canceled or revoked without refund (resale in breach of section 8.5, refusal or removal under section 9.4, a chargeback under section 12), no refund is owed. If we cancel a ticket for any other reason, your remedy is a refund of the price you paid for it, including sales tax.
8.2 Your tickets are in your order confirmation email and in your account. Each ticket has its own QR code, and the code is the ticket.
8.3 The code works like cash. Anyone who presents it first is admitted. We do not check ID at the door unless a show, a seating area or alcohol service requires it. Do not post your code or send a screenshot of it to anyone you are not giving the ticket to. If someone else uses your code first, we cannot admit you and we do not refund you.
8.4 You may not copy, alter, counterfeit or reproduce a ticket or a QR code.
8.5 Tickets are not for resale. You may not buy tickets in order to resell them, sell or offer a ticket for more than you paid for it, or use a ticket for a commercial purpose, as a prize, or in a promotion, without our written permission. Where the law of the show's location permits, we may cancel, without refund, any ticket sold or used in breach of this section, and we may refuse entry to anyone holding it.
9. Getting into the show
9.1 One scan, one admission. Each ticket admits one person, one time. The moment a code is scanned it is spent. If two people present the same code, the first is admitted and the second is refused.
9.2 Arrival. Please arrive before the start time on your ticket. Latecomers are admitted at a suitable break at our staff's discretion, or not at all, without refund. A ticket is valid only for the session it names; our staff may, at their discretion and if space allows, admit you to another session, but are not required to.
9.3 No re-entry. Once you leave the venue your ticket is spent, unless our staff permit re-entry.
9.4 We may refuse entry to, or remove, anyone, without refund, who:
- cannot present a valid, unused ticket;
- behaves in a way that affects the safety or enjoyment of others, or uses threatening, abusive or offensive words or behavior;
- appears to be intoxicated or under the influence of drugs;
- cannot show proof of age where it is required;
- refuses a reasonable search of their person or belongings, or brings in a prohibited item;
- records the performance in breach of section 9.7; or
- does not follow the show rules or the instructions of our staff.
9.5 Accessible seating. Accessible seating and companion seats are available on request at the same price as comparable seats, through the same channels, and we will always try to accommodate you. We do not ask for proof of disability. To ask, email team@concertdome.co or any other address shown on our site, leave a note at checkout where that option is available, or tell our staff on arrival.
9.6 Show conditions. Our shows may involve loud sound, low light, candle-effect lighting, haze or fog, projected light, standing or moving crowds, and stairs. If you have a condition these could affect, contact us before you buy.
9.7 Your own recording. You may take personal photographs and short personal videos unless the show page or venue signage says otherwise. You may not make professional, continuous or full-length recordings, or use any recording commercially, without our written permission.
10. Transferring a ticket
10.1 You may send a ticket to another person using the transfer feature on the order page linked in your order email, or in your account. A transfer is an invitation: your ticket stays yours until the recipient accepts, and you can cancel it before then. When they accept, they receive a fresh code and your old code stops working, including any screenshot of it.
10.2 You may not charge the recipient more than you paid for the ticket. Once a transfer is accepted, the ticket belongs to the recipient and these Terms apply to them. A transferred ticket cannot be refunded by the recipient. The buyer may ask us to refund that ticket, subject to the Refund, Credit and Ticket Policy; if we do, the transferred ticket is canceled and the refund goes to the buyer.
10.3 Transfers close at the cutoff shown at checkout and in your account.
11. Refunds, credit, cancellations and postponements
11.1 The Refund, Credit and Ticket Policy governs this subject and is part of these Terms. In outline:
- Change of mind is at our discretion. Where the show page and checkout say that a show offers refund to credit, you may refund a ticket to ConcertDome credit before the cutoff shown at checkout. Otherwise all sales are final.
- ConcertDome credit does not expire, carries no fees, can be used on any ConcertDome show sold through the Service (not on other events at our venues, such as private events or screenings, unless the event page says so), and is not redeemable for cash except where the law requires or as that policy provides. If we stop presenting shows on which your credit can be used, we will refund your remaining balance to your original payment method where we can, or tell you how to claim it.
- If we cancel a show or a session, we refund the price you paid for it, including sales tax, to your original payment method within 30 days; any part paid with credit goes back to your credit.
- If we move a show to a new date, or to a new time on the same date, your ticket is valid for the new date and time. You may ask us for a refund within 14 days of our notice; whether to grant it is at our discretion.
- Changes to the performers, program, running order, seating layout, or venue within the same city are not a cancellation and do not entitle you to a refund.
- The cutoff is the time, set per show and shown at checkout and in your account, after which refunds to credit and transfers close.
- If you do not attend, no refund or credit is owed.
11.2 We are not responsible for travel, accommodation, parking, childcare or any other arrangement you make around a show.
12. Chargebacks
12.1 If you do not recognize a charge, or something is wrong with your order, contact us first. Our charge appears as CONCERTDOME.
12.2 If you dispute a charge with your bank or card issuer and the dispute is decided against us, the tickets paid for by that charge are canceled and will be refused at the door. We may also refuse future orders from the card, the account or the person involved.
12.3 This does not affect your right to dispute a charge you genuinely did not authorize. If someone used your card without permission, tell us and tell your bank.
13. Using the Service
13.1 You may use the Service to browse shows, buy tickets for yourself and the people you are bringing, manage your tickets and contact us.
13.2 You may not:
- use a bot, script, automated tool or ticket-purchasing software to search for, reserve or buy tickets, or to circumvent a queue, waiting room, presale code, purchase limit, CAPTCHA or other control, which may also violate the federal Better Online Ticket Sales Act (15 U.S.C. § 45c) and Texas Business and Commerce Code § 328.002;
- use multiple accounts, email addresses, payment cards or addresses, or false information, to exceed a purchase limit;
- scrape, crawl, mirror, frame or systematically copy any part of the Service, or extract data from it by automated means;
- interfere with the Service, place an unreasonable load on it, probe or test its security, or try to access any account, system or data that is not yours;
- impersonate anyone or misrepresent your connection with any person or organization, including us;
- reverse engineer, decompile or disassemble any part of the Service, including our tickets and codes; or
- use the Service for anything unlawful.
13.3 We may limit the rate of requests to the Service and we do not publish those limits.
14. Photography and recording of our shows
14.1 We and people we authorize photograph, film and record our shows, and you may appear in that material. Notice may also be posted at the entrance.
14.2 By attending, you, for yourself and for any minor you bring, consent to being photographed, filmed and recorded, and grant ConcertDome and its affiliates a perpetual, worldwide, royalty-free right to use your image, likeness and voice as captured at the show, in any medium now known or later developed, for advertising, promotion, social media and archival purposes, without payment or further notice. You waive any right to inspect or approve that use. The one exception: if we want to feature you individually as the subject of a paid advertisement, we will ask for your separate signed consent first.
15. ASSUMPTION OF RISK AND RELEASE
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS YOUR RIGHT TO SUE.
15.1 ATTENDING A LIVE EVENT INVOLVES INHERENT RISKS, INCLUDING THE RISK OF PERSONAL INJURY, ILLNESS, EXPOSURE TO COMMUNICABLE DISEASE, DEATH, AND LOSS OF OR DAMAGE TO PROPERTY, ARISING FROM THINGS SUCH AS CROWDS, MOVEMENT IN LOW LIGHT, LOUD SOUND, LIGHTING AND ATMOSPHERIC EFFECTS, STAIRS AND UNEVEN SURFACES, AND THE CONDUCT OF OTHER PEOPLE.
15.2 BY ATTENDING, YOU, ON YOUR OWN BEHALF AND ON BEHALF OF ANY MINOR YOU BRING, VOLUNTARILY ASSUME ALL OF THOSE RISKS, WHETHER KNOWN OR UNKNOWN, AND YOU RELEASE, WAIVE AND AGREE NOT TO SUE CONCERTDOME INC., ITS AFFILIATES, THE OWNERS AND OPERATORS OF THE VENUE, ANY COMPANY THAT PRODUCES OR PRESENTS THE SHOW WITH US, THE PERFORMERS, AND EACH OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS AND AGENTS (THE "RELEASED PARTIES") FROM ANY AND ALL CLAIMS FOR INJURY, ILLNESS, DEATH, LOSS OR DAMAGE ARISING OUT OF THOSE RISKS OR YOUR ATTENDANCE, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY.
15.3 THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, WILLFUL MISCONDUCT OR FRAUD, OR TO ANY LIABILITY THAT CANNOT BE RELEASED UNDER APPLICABLE LAW.
15.4 Follow the safety instructions of our staff and any posted health rules. Do not attend if you are unwell.
16. Our content and trademarks
16.1 The Service and everything on it, including artwork, photography, video, program material, page designs, software and text, belongs to us or to people who have licensed it to us, and is protected by copyright, trademark and other laws. You receive only a limited, personal, non-exclusive, non-transferable, revocable permission to use the Service to browse shows and to buy and manage tickets.
16.2 ConcertDome and our logos are trademarks of ConcertDome Inc. First Chair is a trademark of our affiliate TLY Limited, doing business as Concertize, which builds and operates the technology behind the Service, and is used by us under license. Do not use any of these marks without written permission.
16.3 If you send us an idea or feedback, you agree that we may use it without owing you anything.
16.4 Our site may link to other websites, including our payment processor. We are not responsible for them.
17. Support
17.1 You can message us from your account or by replying to any email we have sent you, and we will respond as soon as we reasonably can. Our staff may use automated tools to help answer messages.
18. Privacy
18.1 Our Privacy Policy explains what personal information we collect, how we use and share it, how long we keep it, and the choices you have. It is a notice to you and is not part of this agreement.
19. Suspending or closing accounts
19.1 You may close your account at any time by contacting us. If you hold tickets to a show that has not yet happened, we will honor them. Any ConcertDome credit in the account remains owed to you and is handled under the Refund, Credit and Ticket Policy.
19.2 We may suspend or close your account, cancel orders or tickets, and refuse future orders if we reasonably believe you have breached these Terms, in particular sections 7.3, 8.5 or 13, or if the law requires. Tickets canceled for resale in breach of section 8.5 are not refunded; orders canceled under section 7.3 are refunded as that section provides. Any credit balance remains owed to you under the Refund, Credit and Ticket Policy whether you or we close the account.
19.3 This agreement ends when your account is closed and you hold no ticket and no credit. Sections that by their nature should survive do survive, including sections 8, 11, 12, 14, 15, 16, 20, 21, 22, 23, 24, 25 and 27, and the refund and credit provisions of the Refund, Credit and Ticket Policy.
20. Disclaimer of warranties
20.1 TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, ERROR-FREE OR SECURE, OR THAT ANY SHOW WILL MEET YOUR EXPECTATIONS.
20.2 This section is about the Service. If we cancel a show, section 11 and the Refund, Credit and Ticket Policy apply.
21. LIMITATION OF LIABILITY
21.1 TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER CONCERTDOME NOR ANY RELEASED PARTY IS LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF ENJOYMENT, OR THE COST OF TRAVEL, ACCOMMODATION, PARKING, CHILDCARE OR ANY OTHER ARRANGEMENT MADE AROUND A SHOW, HOWEVER ARISING, EVEN IF ADVISED OF THE POSSIBILITY.
21.2 TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF CONCERTDOME AND THE RELEASED PARTIES, TOGETHER, FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICE, A TICKET OR A SHOW, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR OTHERWISE, WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS ($100).
21.3 These limits do not apply to: our obligation to refund you under the Refund, Credit and Ticket Policy; our obligation to honor your ConcertDome credit; liability for gross negligence, willful misconduct or fraud; or any liability that cannot be limited under applicable law, including your rights under the Texas Deceptive Trade Practices-Consumer Protection Act (section 23).
22. Indemnity
22.1 You agree to defend, indemnify and hold harmless ConcertDome and the Released Parties from any claim brought by a third party, and the resulting losses, damages and costs, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the Service, your resale or commercial use of a ticket, your conduct at a show or that of a minor you bring, or your violation of any law or of anyone's rights. We may take over the defense of any claim covered by this section.
23. Your consumer rights
23.1 Nothing in these Terms waives, limits or restricts any right or remedy that you have under consumer-protection law and that cannot be waived or limited by agreement, including under the Texas Deceptive Trade Practices-Consumer Protection Act (Tex. Bus. & Com. Code § 17.41 et seq.). Any provision that would have that effect does not apply to those rights.
24. DISPUTE RESOLUTION: BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND CONCERTDOME TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND IT WAIVES CLASS ACTIONS AND JURY TRIALS. WHERE MANY SIMILAR CLAIMS ARE FILED TOGETHER, THEY ARE ADMINISTERED IN BATCHES AS SECTION 24.7 DESCRIBES, THOUGH EACH IS DECIDED ON ITS OWN. YOU MAY OPT OUT WITHIN 30 DAYS (SECTION 24.9).
24.1 What this section covers. You and ConcertDome agree that any dispute, claim or controversy arising out of or relating to these Terms, the Service, a ticket, a show, ConcertDome credit, or our relationship (a "Dispute"), including whether a Dispute is subject to arbitration, will be resolved by binding individual arbitration as set out here, except as section 24.2 provides. This section is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).
24.2 Exceptions. Either of us may (a) bring an individual claim in small claims court in your county of residence, if the claim qualifies and stays there; (b) seek an injunction in court to protect intellectual property rights; and (c) bring a claim that applicable law does not allow to be arbitrated. If the law of your state gives you a right to seek public injunctive relief that cannot be waived, that request will be decided by a court after the arbitrator has decided all other issues, and the court proceeding will be stayed until then.
24.3 Talk to us first (required). Before starting an arbitration or a small claims case, the party with the Dispute must send the other a written Notice of Dispute. To us: by email to team@concertdome.co, or by mail to ConcertDome Inc., Attn: Legal, 12420 Thompkins Dr, Austin, TX 78753. To you: to the email address on your account. The Notice must be individual to the Dispute, must include the sender's name, the email address on the account, a description of the Dispute and the specific relief sought, and must be signed personally by the party sending it (you, or an authorized representative of ConcertDome), and by that party's counsel, if any. For 60 days after the Notice is received, you and we will try in good faith to resolve the Dispute, and either of us may ask for a telephone or video conference, which each party must attend personally (for ConcertDome, through a representative with authority to settle) even if represented by a lawyer. Any applicable statute of limitations is paused during those 60 days. A court or arbitrator may dismiss, without prejudice, any arbitration or claim filed without first completing this step.
24.4 The arbitration. The arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures and its Consumer Arbitration Minimum Standards then in effect (available at www.jamsadr.com), as modified by this section, before a single arbitrator. If JAMS is unavailable, you and we will agree on another administrator or ask a court to appoint one. The arbitrator will apply Texas law, and may award the same individual relief a court could award, including statutory damages and attorneys' fees where the law provides them, and must issue a written decision with reasons. The arbitrator, and not a court, decides all questions about the scope, enforceability and interpretation of this section, except that a court decides whether sections 24.6 and 24.7 are enforceable.
24.5 Where, how and who pays. You may choose to have the arbitration conducted on documents only, by telephone or video, or in person in the county where you live; any in-person hearing will be held in the county where you live unless you and we agree otherwise. You pay the consumer filing fee set by the JAMS Consumer Arbitration Minimum Standards. We pay only the JAMS filing, administrative and arbitrator fees that those standards require a business to pay, and nothing more. If the arbitrator finds that your claim was frivolous or brought for an improper purpose, the arbitrator may require you to reimburse the fees we paid, to the extent the JAMS rules allow. Each side pays its own attorneys' fees unless the law or the arbitrator provides otherwise.
24.6 CLASS ACTION AND REPRESENTATIVE WAIVER. YOU AND CONCERTDOME AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims (except as section 24.7 provides) and may not preside over any form of class or representative proceeding. If this section 24.6 is found unenforceable as to a particular claim or request for relief, that claim or request, and only it, will be severed and brought in court under section 25, and will be stayed pending the arbitration of all other claims.
24.7 Coordinated filings. If 25 or more Notices of Dispute or demands for arbitration raising similar claims are filed against us within 90 days by claimants represented by the same lawyer or law firm, or by lawyers or firms acting in coordination, JAMS will administer them under its Mass Arbitration Procedures and Guidelines in batches of up to 50 claims, with one arbitrator and one hearing schedule per batch and fees as those procedures then provide for batched claims. Batches may proceed at the same time, and any applicable statute of limitations is paused for a claim while it waits to be assigned to a batch. Each claim in a batch is decided individually on its own facts; no decision in one claim binds another claimant. A Process Administrator appointed by JAMS under those procedures will decide whether this section 24.7 applies to a set of filings and how batches are formed. You and we agree that this procedure does not create a class, collective or representative proceeding. If this section 24.7 is found unenforceable as to a claimant, it is severed as to that claimant only.
24.8 Jury waiver. By agreeing to arbitrate, you and we each give up the right to a trial by jury and to have a Dispute decided by a judge.
24.9 Your right to opt out. You may opt out of this section 24 by emailing team@concertdome.co within 30 days after you first agree to these Terms, with the subject line "Arbitration Opt-Out," your name, the email address on your account, and a clear statement that you opt out. Opting out is mutual: if you opt out, we are not bound to arbitrate with you either. Opting out does not affect any other part of these Terms.
24.10 Changes to this section. We may change this section 24 only on at least 30 days' notice. A change applies only to orders placed after it takes effect; a Dispute about an earlier order is governed by the version of this section in effect when that order was placed, and no change applies to a Dispute of which either of us has given notice before the change took effect. Changes apply equally to claims by you and by us. If you do not accept a change to this section, you may reject it by emailing team@concertdome.co within 30 days after it takes effect, in which case the version you last agreed to continues to govern Disputes between you and us.
24.11 This section 24 survives the end of our relationship.
25. Governing law, courts and time limit
25.1 These Terms, and any Dispute, are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and, for section 24, by the Federal Arbitration Act. Where a show takes place outside Texas, any law of the state where it takes place that cannot be displaced by agreement applies to that show, and these Terms apply to the fullest extent that law allows.
25.2 For any claim that is not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Texas, with venue in Travis County to the extent permitted by law, except that either of us may bring a qualifying claim in small claims court in your county of residence.
25.3 JURY WAIVER. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND CONCERTDOME EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICE, A TICKET OR A SHOW.
25.4 Time limit. Any claim arising out of or relating to these Terms, the Service, a ticket or a show must be brought within two years after it accrues, or it is permanently barred. This section does not shorten any period that the law does not allow to be shortened.
26. Changes to these Terms
26.1 We may change these Terms. If a change is material, we will give at least 30 days' notice before it takes effect, by email to the address on your account and by notice on our site.
26.2 A change applies only to orders placed after it takes effect. An order you placed earlier keeps the version of these Terms in effect when you placed it.
26.3 Changes to section 24 are governed by section 24.10. Any change to sections 24 or 25 (the dispute-resolution provisions) applies only to orders placed after it takes effect, applies equally to both of us, and does not apply to any claim that arose, or of which either of us gave notice, before the change took effect. The Refund, Credit and Ticket Policy changes under this section 26 as well.
26.4 You agree to a new version by selecting Place Order, signing in, or accepting a transfer after it takes effect. If you do not agree, do not place further orders.
27. General
27.1 Severability. If any provision of these Terms is held unenforceable, it will be limited or removed to the minimum extent necessary and the rest will remain in force, except as sections 24.6 and 24.7 provide.
27.2 No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
27.3 Entire agreement. These Terms, with the Refund, Credit and Ticket Policy and any show rules, are the entire agreement between you and us about the Service and your tickets.
27.4 Assignment. We may assign these Terms to an affiliate or in connection with a sale or reorganization of our business. You may not assign them.
27.5 Third-party beneficiaries. The Released Parties may enforce sections 14, 15, 21 and 22. There are no other third-party beneficiaries.
27.6 Interpretation. Headings and the summary at the top are for convenience and are not part of the agreement. "Including" means "including without limitation." Where we say we "may" do something, we may but need not.
27.7 Force majeure. We are not liable for any failure or delay in putting on a show caused by events beyond our reasonable control, including severe weather, fire, flood, failure of utilities or transport, act of a public authority, civil disorder, epidemic, or the illness or unavailability of a performer. Where such an event leads us to cancel a show, the Refund, Credit and Ticket Policy applies.
